Artikel 1. Definities
1.1. Kool Design: ingeschreven bij de Kamer van Koophandel onder dossiernummer 50964097.
1.2. Klant: de natuurlijke persoon die als consument handelt en een overeenkomst aangaat met Kool Design. Onder 'consument' wordt verstaan een natuurlijke persoon die niet handelt in de uitoefening van beroep of bedrijf.
1.3. Onder 'Algemene Voorwaarden' wordt verstaan: het geheel van de bepalingen zoals hierna opgenomen.

Artikel 2. Toepasselijkheid / uitvoering
2.1. Op alle aanbiedingen, overeenkomsten en leveringen van Kool Design zijn deze Algemene Voorwaarden van toepassing, tenzij schriftelijk uitdrukkelijk anders is overeengekomen.
2.2. Indien Klant in zijn opdracht bepalingen of voorwaarden opneemt die afwijken van, of niet voorkomen in, deze voorwaarden zijn deze voor Kool Design alleen bindend indien en voor zover deze door Kool Design uitdrukkelijk schriftelijk zijn aanvaard.
2.3. Kool Design is gerechtigd derden in te schakelen bij het uitvoeren van haar overeenkomsten.
Artikel 3. Aanbiedingen
3.1. Indien blijkt dat bij de aanvraag of overeenkomst door Klant verstrekte gegevens onjuist waren, heeft Kool Design het recht de prijzen hieraan aan te passen.
3.2. Aanbiedingen van Kool Design zijn geldig voor de op de Website aangegeven termijn.
3.3. Kool Design zal zich inspannen om de afbeeldingen van de producten op de Website zo goed mogelijk in overeenstemming te laten zijn met de werkelijkheid, tenzij anders aangegeven op de website.
Artikel 4. Prijzen
4.1. Alle prijzen zijn inclusief omzetbelasting en andere heffingen welke van overheidswege worden opgelegd.
4.2. Alle prijzen op de Website zijn onder voorbehoud van programmeer- en typefouten.
Artikel 5. Overeenkomst / levertijd
5.1. Indien Klant het aanbod langs elektronische weg heeft aanvaard, bevestigt Kool Design onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod. Zolang de ontvangst van deze aanvaarding niet is bevestigd, heeft Klant de mogelijkheid de overeenkomst te ontbinden.
5.2. Klant heeft het recht de op afstand gesloten overeenkomst met Kool Design binnen 7 werkdagen na ontvangst van het product, zonder opgaaf van redenen, te ontbinden. De rechtstreekse kosten voor het terugzenden van het product zijn voor rekening van Klant. Dit geldt niet voor producten of goederen die speciaal voor de klant op maat zijn gemaakt.
5.3. Kool Design raadt Klant aan de geleverde goederen onmiddellijk na ontvangst te inspecteren en eventuele gebreken binnen bekwame tijd schriftelijk dan wel per e-mail info@kool-design.nl te melden (zie ook Artikel 10 Reclame).
5.4. Kool Design is niet aansprakelijk voor enige schade, diefstal of verlies, die bij terugzending aan de verpakking of het product ontstaat.
5.5. Na ontvangst van de betaling door Kool Design, stuurt Kool Design de producten zo spoedig mogelijk toe.
5.6. Indien producten niet voorradig zijn en de levertijd zoals die op de website staat niet haalbaar is, neemt Kool Design contact met u op.
5.7. De gemiddelde levertijd zal tussen de 2 à 3 weken bedragen, tenzij anders aangegeven. Indien de levertijd langer dan 6 maanden duurt (tenzij anders aangegeven), heeft Klant het recht de overeenkomst schriftelijk te ontbinden. In dat geval zal Kool Design eventuele gedane betalingen zo spoedig mogelijk, maar uiterlijk binnen 14 dagen na ontbinding aan Klant terugbetalen.
5.8. Zodra de te leveren producten op het opgegeven afleveradres zijn geleverd, gaat het risico, wat deze producten betreft, over op Klant.
Artikel 6. Eigendomsvoorbehoud
6.1. Zolang Klant geen volledige betaling over het gehele overeengekomen bedrag heeft verricht, blijven alle geleverde goederen eigendom van Kool Design.
Artikel 7. Betalingsvoorwaarden
7.1. De klant dient de betaling aan Kool Design te voldoen door middel van contante betaling of bankoverschrijving op het moment van overhandiging van de goederen of factuur, tenzij schriftelijk anders overeengekomen.
7.2. Bij een niet tijdige betaling is Klant, naast het verschuldigde bedrag en de daarop verschenen rente, gehouden tot een volledige vergoeding van zowel buitengerechtelijke als gerechtelijke incassokosten, inclusief de kosten voor advocaten, deurwaarders en incassobureaus.
7.3. De vordering tot betaling is direct opeisbaar ingeval Klant in staat van faillissement wordt verklaard, surseance van betaling aanvraagt dan wel algeheel beslag op vermogensbestanddelen van Klant wordt gelegd, Klant overlijdt en voorts, indien deze in liquidatie treedt of wordt ontbonden.
7.4. In bovenstaande gevallen heeft Kool Design tevens het recht de overeenkomst of het nog niet uitgevoerde gedeelte daarvan zonder ingebrekestelling of rechterlijke interventie te beëindigen of op te schorten, onverminderd het recht van Kool Design vergoeding te verlangen voor eventuele schade die voor hem hierdoor mocht ontstaan.
Artikel 8. Overmacht
8.1. In geval van overmacht is Kool Design niet gehouden tot vergoeding van de daardoor bij Klant ontstane schade.
Artikel 9. Garantie
9.1. Klant heeft de rechten met betrekking tot garantie zoals die in het Burgerlijk Wetboek Boek 7, titel 1 van het Burgerlijk Wetboek zijn opgenomen.
9.2. Kool Design garandeert gedurende een termijn van zes maanden na aflevering de afwezigheid van gebreken bij koop en vervaardiging van sieraden.
9.3. Kool Design is niet aansprakelijk voor defecten aan de Producten die optreden na levering, veroorzaakt door onjuist gebruik of onvoldoende zorg door de Consument, of door wijzigingen aan het Product gemaakt door de Consument of door derden. Schade die voortvloeit uit dergelijke defecten valt eveneens buiten de verantwoordelijkheid van de Ondernemer.
Artikel 10. Reclame
10.1. Indien het afgeleverde product niet aan de overeenkomst beantwoordt, dient Klant binnen een termijn van twee weken na ontdekking hiervan, Kool Design in kennis te stellen. Gebeurt dat niet, dan vervalt elke aanspraak ten aanzien van Kool Design.
10.2. Indien Kool Design de reclame gegrond acht, worden na overleg met Klant de relevante producten gerepareerd, vervangen of vergoed.
10.3. De maximale vergoeding is gelijk aan de door Klant betaalde prijs voor het product.
10.4. Reclame schort verplichtingen van Klant niet op.
Artikel 11. Intellectuele eigendom
Ontwerpen, tekeningen, berekeningen, beschrijvingen, modellen en andere prestaties die door de Ondernemer zijn gecreëerd of geleverd, vormen intellectueel eigendom dat toebehoort aan de Ondernemer en/of de maker ervan. Het is verboden deze materialen of de daaruit voortvloeiende producten te dupliceren of openbaar te maken zonder expliciete voorafgaande goedkeuring van de Ondernemer.
Artikel 12. Conformiteit
12.1. De Ondernemer staat ervoor in dat het geleverde Product beantwoordt aan de Overeenkomst (conformiteit). De Ondernemer staat er bovendien voor in dat het Product die eigenschappen bezit die, alle omstandigheden in aanmerking genomen, voor normaal gebruik nodig zijn, alsmede voor bijzonder gebruik voor zover dat is overeengekomen.
12.2 De Ondernemer staat ervoor in dat de door hem verrichte werkzaamheden beantwoorden aan de Overeenkomst en worden uitgevoerd met goed vakmanschap en met gebruikmaking van deugdelijk materiaal.
12.3 Minimale afwijkingen t.a.v. ontwerp, monster en model kunnen de Ondernemer niet worden tegengeworpen.
Artikel 13. Slotbepalingen
13.1. Op de overeenkomst is Nederlands recht van toepassing.
13.2. Voor zover door de regels van dwingend recht niet anders wordt voorgeschreven, zullen alle geschillen die mochten ontstaan naar aanleiding van de Overeenkomst worden voorgelegd aan de bevoegde rechtbank.
13.3. Partiële nietigheid: Indien een bepaling in deze Algemene Voorwaarden nietig blijkt te zijn, tast dit niet de geldigheid van de gehele Algemene Voorwaarden aan. Partijen zullen ter vervanging (een) nieuwe bepaling(en) vaststellen, waarmee zoveel als rechtens mogelijk is aan de bedoeling van de oorspronkelijke Algemene Voorwaarden gestalte wordt gegeven.
Artikel 14. Ringmaten en Verificatie
14.1. Indien een klant de ringmaat per e-mail aan ons doorgeeft met het verzoek om ringen te vervaardigen, is de door de klant opgegeven ringmaat bindend. Kool Design zal de productie van de ringen baseren op deze doorgegeven maat. Het is de verantwoordelijkheid van de klant om te zorgen dat de doorgegeven maat correct is. Kool Design is niet verantwoordelijk voor eventuele onnauwkeurigheden in de door de klant verstrekte ringmaat.
14.2. Wanneer klanten ons atelier bezoeken en wij de ringmaten opnemen, zullen deze maten worden benoemd in de offerte. Door akkoord te gaan met de offerte, bevestigt de klant de nauwkeurigheid van deze maten en worden deze maten bindend voor de productie van de ringen. Het is essentieel dat klanten de in de offerte vermelde maten zorgvuldig controleren en hun akkoord geven, aangezien deze maten de basis vormen voor de vervaardiging van de ringen.
14.3. Het akkoord van de klant, hetzij door expliciete acceptatie van de offerte of door het verstrekken van maten via e-mail, wordt beschouwd als een definitieve bevestiging van de specificaties voor de ringen. Kool Design gaat uit van de juistheid van deze specificaties en zal dienovereenkomstig handelen in de productie van de ringen. Eventuele aanpassingen of wijzigingen na deze bevestiging kunnen onderhevig zijn aan extra kosten.
Het is belangrijk voor klanten om te begrijpen dat veranderingen in het lichaamsgewicht of de vingeromvang kunnen optreden als gevolg van seizoensgebonden veranderingen of andere factoren. Kool Design kan niet verantwoordelijk worden gesteld voor eventuele veranderingen in de pasvorm van de trouwringen na de opnamedatum.
Artikel 15. Internationale Bestellingen en Verantwoordelijkheden
Voor klanten buiten de Europese Unie (EU): wees u ervan bewust dat u als klant verantwoordelijk bent voor het betalen van alle invoerrechten, belastingen en andere heffingen die door uw land worden geïnd voor het importeren van producten. Deze kosten zijn niet inbegrepen in de aankoopprijs of verzendkosten die door Kool Design worden gefactureerd. Het is uw verantwoordelijkheid om uzelf te informeren over en te voldoen aan de lokale wetgeving en regelgeving met betrekking tot invoerrechten en belastingen.
Updatebeleid voor Algemene Voorwaarden
Wijzigingen en Updates
Wij behouden ons het recht voor om deze Algemene Voorwaarden op elk moment te wijzigen of te updaten. Veranderingen in onze bedrijfsvoering, marktomstandigheden, wetgeving of regelgeving kunnen dergelijke updates noodzakelijk maken. We streven ernaar om onze klanten te voorzien van duidelijke, eerlijke en transparante voorwaarden die de kwaliteit en betrouwbaarheid van onze dienstverlening weerspiegelen.
Communicatie van Wijzigingen
Voorafgaande Kennisgeving: Wanneer wij wezenlijke wijzigingen in onze Algemene Voorwaarden aanbrengen, zullen we u hiervan minstens 30 dagen voor de inwerkingtreding van de wijzigingen op de hoogte stellen. Deze kennisgeving kan plaatsvinden via onze website, per e-mail, of door een andere vorm van communicatie waarmee we u effectief kunnen bereiken.
Toegang tot de Bijgewerkte Voorwaarden: De meest actuele versie van onze Algemene Voorwaarden is te allen tijde beschikbaar op onze website. Wij moedigen u aan deze regelmatig te raadplegen om op de hoogte te blijven van eventuele wijzigingen.
Acceptatie van Wijzigingen: Door onze diensten te blijven gebruiken na de inwerkingtreding van deze wijzigingen, geeft u aan de bijgewerkte voorwaarden te accepteren. Indien u het niet eens bent met de gewijzigde voorwaarden, heeft u het recht om uw relatie met ons te beëindigen.

Update Policy for General Terms and Conditions
Article 1. Definitions
1.1. Kool Design: registered with the Chamber of Commerce under file number 50964097.
1.2. Customer: the natural person who acts as a consumer and enters into an agreement with Kool Design. 'Consumer' means a natural person who does not act in the course of a profession or business.
1.3. "General Terms and Conditions" shall mean: all provisions as set forth herein.

Article 2. Applicability / execution
2.1. These General Terms and Conditions apply to all offers, agreements, and deliveries from Kool Design, unless expressly agreed otherwise in writing.
2.2. If the Customer includes provisions or conditions in their order that deviate from or are not included in these terms and conditions, they shall only be binding on Kool Design if and insofar as they have been expressly accepted in writing by Kool Design.
2.3. Kool Design is authorized to engage third parties in the execution of its agreements.
Article 3. Offers
3.1. If it appears that the data provided by the Customer in the request or agreement was incorrect, Kool Design has the right to adjust the prices accordingly.
3.2. Offers from Kool Design are valid for the period indicated on the Website.
3.3. Kool Design will make every effort to ensure that the images of the products on the Website correspond as closely as possible to reality, unless otherwise indicated on the website.
Article 4. Prices
4.1. All prices include VAT and other taxes imposed by the government.
4.2. All prices on the Website are subject to programming and typographical errors.
Article 5. Agreement / delivery time
5.1. If the Customer accepts the offer electronically, Kool Design will immediately confirm receipt of the acceptance of the offer electronically. Until the receipt of this acceptance has been confirmed, the Customer has the option to dissolve the agreement.
5.2. The Customer has the right to dissolve the distance contract concluded with Kool Design within 7 working days after receipt of the product, without stating reasons. The direct costs for returning the product are at the expense of the Customer. This does not apply to products or goods that are specially tailored to the customer.
5.3. Kool Design advises the Customer to inspect the delivered goods immediately upon receipt and to report any defects in writing or by email to info@kool-design.nl within a reasonable time (see also Article 10 Complaints).
5.4. Kool Design is not liable for any damage, theft, or loss occurring during the return of the packaging or the product.
5.5. Upon receipt of payment by Kool Design, Kool Design will send the products as soon as possible.
5.6. If products are not in stock and the delivery time as stated on the website is not feasible, Kool Design will contact you.
5.7. The average delivery time will be between 2 to 3 weeks, unless otherwise stated. If the delivery time exceeds 6 months (unless otherwise stated), the Customer has the right to dissolve the agreement in writing. In that case, Kool Design will refund any payments made to the Customer as soon as possible, but no later than within 14 days after dissolution.
5.8. Once the products to be delivered have been delivered to the specified delivery address, the risk with regard to these products passes to the Customer.
Article 6. Retention of title
6.1. As long as the Customer has not made full payment of the entire agreed amount, all delivered goods remain the property of Kool Design.
Article 7. Payment terms
7.1. The customer must make payment to Kool Design in cash or by bank transfer at the time of delivery of the goods or invoice, unless otherwise agreed in writing.
7.2. In the event of late payment, the Customer, in addition to the amount due and the interest accrued thereon, is obliged to fully compensate both extrajudicial and judicial collection costs, including the costs for lawyers, bailiffs, and collection agencies.
7.3. The claim for payment is immediately due and payable if the Customer is declared bankrupt, applies for a suspension of payments, if all or part of the Customer's assets are seized, if the Customer dies, and furthermore, if it enters into liquidation or is dissolved.
7.4. In the above cases, Kool Design also has the right to terminate or suspend the agreement or the unfulfilled part thereof without notice of default or judicial intervention, without prejudice to Kool Design's right to demand compensation for any damage that may arise as a result.
Article 8. Force majeure
8.1. In the event of force majeure, Kool Design is not obliged to compensate for any damage incurred by the Customer.
Article 9. Warranty
9.1. The Customer has the rights with regard to warranty as set forth in Book 7, title 1 of the Dutch Civil Code.
9.2. Kool Design guarantees the absence of defects in the purchase and manufacture of jewelry for a period of six months after delivery.
9.3. Kool Design is not liable for defects in the Products that occur after delivery, caused by incorrect use or insufficient care by the Consumer, or by modifications to the Product made by the Consumer or by third parties. Damage resulting from such defects is also beyond the responsibility of the Entrepreneur.
Article 10. Complaints
10.1. If the delivered product does not comply with the agreement, the Customer must inform Kool Design of this within a period of two weeks after discovery. If this does not happen, any claim against Kool Design lapses.
10.2. If Kool Design deems the complaint justified, the relevant products will be repaired, replaced, or refunded after consultation with the Customer.
10.3. The maximum compensation is equal to the price paid by the Customer for the product.
10.4. Complaints do not suspend the obligations of the Customer.
Article 11. Intellectual property
Designs, drawings, calculations, descriptions, models, and other performances created or supplied by the Entrepreneur constitute intellectual property belonging to the Entrepreneur and/or the creator thereof. It is prohibited to duplicate or disclose these materials or the resulting products without the explicit prior approval of the Entrepreneur.
Article 12. Conformity
12.1. The Entrepreneur guarantees that the delivered Product complies with the Agreement (conformity). The Entrepreneur also guarantees that the Product possesses the properties necessary for normal use, taking all circumstances into account, as well as for special use as agreed.
12.2. The Entrepreneur guarantees that the work performed by him complies with the Agreement and is carried out with good workmanship and using sound materials.
12.3. Minor deviations regarding design, sample, and model cannot be objected to by the Entrepreneur.
Article 13. Final provisions
13.1. Dutch law applies to the agreement.
13.2. To the extent that mandatory rules do not prescribe otherwise, all disputes arising from the Agreement shall be submitted to the competent court.
13.3. Partial nullity: If a provision in these General Terms and Conditions is found to be invalid, this does not affect the validity of the entire General Terms and Conditions. The parties will establish (a) new provision(s) to replace it, which as closely as possible reflect the intention of the original General Terms and Conditions.
Article 14. Ring Sizes and Verification
14.1. If a customer provides their ring size via email with a request to manufacture rings, the ring size given by the customer is binding. Kool Design will base the production of the rings on this provided size. It is the customer's responsibility to ensure that the size provided is accurate. Kool Design is not responsible for any inaccuracies in the ring size provided by the customer.
14.2. When customers visit our studio and we measure their ring sizes, these sizes will be stated in the quote. By agreeing to the quote, the customer confirms the accuracy of these sizes, and these sizes become binding for the production of the rings. It is essential that customers carefully check the sizes listed in the quote and give their agreement, as these sizes form the basis for the manufacturing of the rings.
14.3. The customer's agreement, whether through explicit acceptance of the quote or by providing sizes via email, is considered a definitive confirmation of the specifications for the rings. Kool Design assumes the accuracy of these specifications and will act accordingly in the production of the rings. Any adjustments or changes after this confirmation may be subject to additional costs.
It is important for customers to understand that changes in body weight or finger size may occur due to seasonal changes or other factors. Kool Design cannot be held responsible for any changes in the fit of the wedding rings after the date of measurement.
Article 15. International Orders and Responsibilities
For customers outside the European Union (EU): please be aware that you as a customer are responsible for paying all import duties, taxes, and other charges imposed by your country for importing products. These costs are not included in the purchase price or shipping costs billed by Kool Design. It is your responsibility to inform yourself about and comply with local laws and regulations regarding import duties and taxes.
Changes and Updates
We reserve the right to change or update these Terms and Conditions at any time. Necessary updates may be the result of changes in our business operations, market conditions, legislation, or regulatory requirements. Our goal is to provide our customers with clear, honest, and transparent terms that reflect the quality and dependability of our services.
Communication of Changes
Prior Notification: Should we make significant changes to our Terms and Conditions, we will inform you at least 30 days before these changes come into effect. You will be notified through our website, via email, or by any other means of communication that enables us to reach you effectively.
Access to Updated Terms: The most current version of our Terms and Conditions is always available on our website. We encourage you to consult it regularly to stay informed of any changes.
Acceptance of Changes: By continuing to use our services after these changes take effect, you indicate your acceptance of the updated terms. If you do not agree with the revised terms, you have the right to terminate your relationship with us.
